Limited Warranty

What this Warranty Covers

Products covered by this Warranty (the Product):

  • Lynx
  • Lynx VTOL

Swift Radioplanes, LLC (“Swift Radioplanes”) warrants to the original purchaser (the Purchaser, the User, you) that the Product and any variant thereof will be free from defects in materials and workmanship, pursuant to the following terms and conditions. This limited warranty extends only to the original Purchaser of the Product for a period of 60 days or up to but not including the first flight of the Product, whichever comes first. Manufacturing defects identified during that period will be repaired by Swift Radioplanes or replaced with a new or refurbished Product or parts of the same or similar design. Swift Radioplanes will not accept goods that have been clearly used more than the amount needed to evaluate their functionality.

What is Not Covered
This warranty is not transferable and does not cover:

  • Cosmetic damage; or
  • Damage due to acts of God, accident, misuse, abuse, negligence, improper use, improper installation or maintenance; or
  • Damage due to shipping other than the original shipping from Swift Radiopanes to the Purchaser; or
  • Modification of or to any part of the Product; or
  • Product not purchased directly from Swift Radioplanes or from an authorized Swift Radioplanes dealer; or
  • Charges for training, setup, consulting, installation or repair of any equipment or software that is not part of the Product as shipped by Swift Radioplanes.

OTHER THAN THE EXPRESS WARRANTY ABOVE, SWIFT RADIOPLANES MAKES NO OTHER WARRANTY OR REPRESENTATION, AND HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE PURCHASER ACKNOWLEDGES THAT THEY ALONE HAVE DETERMINED THAT THE PRODUCT WILL SUITABLY MEET THE REQUIREMENTS OF THE PURCHASER’S INTENDED USE.

Purchaser’s Remedy
Swift Radioplanes’s sole obligation and the Purchaser’s sole and exclusive remedy shall be that Swift Radioplanes will, at its option, either (i) service, or (ii) replace, any Product determined by Swift Radioplanes to be defective. Swift Radioplanes reserves the right to inspect any and all Product(s) involved in a warranty claim. Service or replacement decisions are at the sole discretion of Swift Radioplanes. Proof of purchase is required for all warranty claims. SERVICE OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE PURCHASERS SOLE AND EXCLUSIVE REMEDY.

Warranty Claim

To obtain warranty service, please contact support@srp.aero with a short incident report that includes the following information:

  • The description of the problem; and
  • A picture of the Product or component; and
  • The contact information of the Purchaser

If Swift Radioplanes determines that the problem is covered by this Limited Warranty, it may be resolved in several ways:

  • By sending you a replacement part/component. You may or may not be asked to return the defective part/component; or
  • If your problem is with software/firmware, you may be asked to download patches, new versions, or engage in live customer support through telephone or telecommunications application software; or
  • By sending you a complete new Product and having you return the defective Product in the original packaging provided/transport case.

If the issue with the Product is not covered by this limited warranty, Swift Radioplanes will notify you and request that you authorize the cost of repair prior to any further repair activity. You must pay for the cost of repair and return shipping costs for the repair of Products that are not covered by this limited warranty.

Service Agreement

Swift Radiplanes will offer replacement Products/parts/components and repairs at a 20% discount for a period of one year from purchase. This agreement extends only to the original Purchaser when the Product is used normally and in accordance with operational instructions.

What is Not Covered
This service agreement is not transferable and does not cover:

  • Cosmetic damage; or
  • Damage due to acts of God, accident, misuse, abuse, negligence, improper use, improper installation or maintenance; or
  • Damage due to shipping other than the original shipping from Swift Radiopanes to the Purchaser; or
  • Modification of or to any part of the Product; or
  • Product not purchased directly from Swift Radioplanes or from an authorized Swift Radioplanes dealer; or
  • Product that is stolen; or
  • Product whose serial numbers/tail number or electronic serial numbers have been removed, modified, or rendered illegible; or
  • Electro optical sensors, payloads, or lenses; or
  • A fly-away; or
  • Consumable items such as breakaway components and propellers; or
  • Batteries, as batteries are considered a consumable item; or
  • Parts with a flight-hour limit designated within the applicable maintenance section of the Product manual/publication; or
  • Software.

Return Policy

The return policy applies to all products sold by or through Swift Radioplanes. If for any reason you are dissatisfied with your purchase, return the unwanted and unused product within 30 days from the original invoice date. Product returns are subject to industry standard 15% restocking fee due to testing and refurbishing requirements. Return shipping charges are the responsibility of The Purchaser.

Limitation of Liability

SWIFT RADIOPLANES SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR PRODUCTION OR COMMERCIAL LOSS IN ANY WAY, REGARDLESS OF WHETHER SUCH CLAIM IS BASED IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY OF LIABILITY, EVEN IF SWIFT RADIOPLANES HAS BEEN ADVISED OF SUCH DAMAGES. Further, in no event shall the liability of Swift Radioplanes exceed the individual price of the Product on which liability is asserted. As Swift Radioplanes has no control over use, setup, final assembly, modification or misuse, no liability shall be assumed nor accepted for any resulting damage or injury. By the act of use, setup or assembly, the User accepts all resulting liability. If you as the Purchaser or the User are not prepared to accept the liability associated with the use of the Product, Purchaser is advised to return the Product immediately in new and unused condition to the place of purchase.

Law
These terms are governed by Arizona law (without regard to conflict of law principals). This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Swift Radioplanes reserves the right to change or modify this warranty at any time without notice.

Although the utmost care has been taken to ensure the accuracy of the information published on the Swift Radioplanes website, including their content and function, ANY CONTENT IS PROVIDED “AS IS” TO THE FULLEST EXTENT PERMITTED BY LAW.

Shipping

All products are shipped using standard published carrier rates and policies. No “handling” fees or markup of shipping charge will be added by Swift Radioplanes. FedEx Ground and International Air Economy shipping are the standard unless otherwise requested by the Purchaser.

The Product will ship its respective transport case. Additional packaging may be added for transit.

Safety

Lynx is a sophisticated Product and not a toy. It must be operated with caution and common sense. As the end user of the Product, you are solely responsible for operating in a manner that does not endanger yourself and others or result in damage to the Product or the property of others. As the Product is controlled by a radio signal, it may be subject to interference from many sources outside your control. As the Product is airborne, it may be subject to weather hazards outside your control.

Guidelines

  • Avoid flights over populated areas, open-air assembly of people, and heavily trafficked roads
  • Avoid flights with proximity to any airport or heliport
  • Avoid flights higher than 400 ft AGL
  • Avoid operations beyond line-of-sight
  • Adhere to any directions, warnings, limitations, disclaimers, pre-flight steps for the Product
  • Avoid water exposure to any equipment not specifically designed and protected for this purpose
  • Check current weather conditions before each flight
  • Check battery voltage levels before each flight
  • Keep moving parts clean
  • Always avoid the propeller arc of the Product
  • Ensure failsafes are properly set before flying
  • Inspect the Product before and after every flight. The Pilot in Command (PIC) is responsible for determining the airworthiness of the Product prior to every flight.
  • Never operate the Product with damage to the airframe or components
